[Penalties]

1. Member States shall lay down the rules on penalties, applicable to infringements of the provisions of this Regulation and shall take all measures necessary to ensure that they are implemented, including where the controller did not comply with the obligation to designate a representative. The penalties provided for must be effective, proportionate and dissuasive.

[Administrative sanctions]

2a. To anyone who does not comply with the obligations laid down in this Regulation, the supervisory authority shall impose at least one of the following sanctions:

• (a) a warning in writing in cases of first and non-intentional non-compliance;
• (b) regular periodic data protection audits;
• (c) a fine up to 100 000 000 EUR or up to 5% of the annual worldwide turnover in case of an enterprise, whichever is greater.

7. The Commission shall be empowered to adopt delegated acts in accordance with Article 86 for the purpose of updating the absolute amounts of the administrative fines referred to in paragraphs 2a, taking into account the criteria and factors referred to in paragraphs 2 and 2c.

[Last onder bestuursdwang]

Het College is bevoegd tot oplegging van een last onder bestuursdwang ter handhaving van de bij of krachtens deze wet gestelde verplichtingen.

[Bestuurlijke boete]

Het College kan aan de verantwoordelijke een bestuurlijke boete opleggen van ten hoogste EUR 4 500 ter zake van overtreding van het bij of krachtens artikel 27, 28 of 79, eerste lid, bepaalde.

[Strafrechtlijke sancties]

1. De verantwoordelijke die in strijd handelt met hetgeen bij of krachtens artikel 4, derde lid, 27, 28 of 78, tweede lid, onder a, is bepaald, wordt gestraft met geldboete van de tweede categorie.

2. De verantwoordelijke die een feit als bedoeld in het eerste lid, opzettelijk begaat, wordt gestraft met gevangenisstraf van ten hoogste zes maanden of geldboete van de derde categorie.
